Download and Usage Terms
These Download and Usage Terms ('Terms') apply to the download of images and texts (collectively 'Works') made available within the framework of this database, which is operated by Tiroler Glashütte GmbH ('Riedel'). By downloading any Work, you agree to these Terms and these Terms shall apply to each Work you download. If you download any Work on behalf of an entity, these Terms shall apply to such entity. In such case, you represent and warrant that you have the authority to validly bind such entity. You or the entity on whose behalf you download any of the Works is henceforth referred to as the 'Licensee'.
1. Grant of Rights and Restrictions
1.1. Riedel (or its licensors respectively, henceforth collectively referred to as Riedel) is the sole and unrestricted owner of all rights in the Works. Riedel at all times retains all rights, title and interest in and to any Works contained in this Data Base. Except as expressly stated in these Terms, Riedel grants no right or license, express or implied, to the Works.
1.2. By downloading any of the Works from this Data Base, Riedel grants to Licensee a non-exclusive, perpetual, geographically unlimited, non-sub-licensable, non-transferable and royalty free right to use the Works to the extent stated in these Terms. Any provided works may only be used in accordance with these Terms.
1.3. Licensee shall not be allowed to remove any copyright or proprietary notice or other information that may appear on, be embedded in, or which is used in connection with the Works in its original or downloaded form. Licensee shall not be allowed to modify any of the Works, except for modifications necessary in order to secure the quality, for reasons of presentation (e.g. cropping of works) or for urgent technical reasons.
1.4. Riedel reserves the right to revoke or restrict the rights granted under these Terms at any time.
2. Warranty and Limitation of Liability

2.2. To the extent permitted by law, Riedel shall not be liable for any damages that result from the use or inability to use the Works according to these terms, unless such damages are caused by Riedel's gross negligence or wilful misconduct.
3. Severability
If any of the provisions of these Terms should be or become illegal or unenforceable, the validity, legality and enforceability of the remaining provisions of these Terms shall not be affected. Such provisions shall be deemed automatically replaced by valid and enforceable provisions, which achieve the intended effect as close as possible.
4. Governing Law, Venue
4.1. These Terms shall be governed by the laws of Austria, without reference to its conflicts of laws rules.
4.2. Any disputes concerning these Terms, including the issue of their valid conclusion and their pre- and post-contractual effects, shall be exclusively decided either by the competent court for the district where Riedel has his registered seat, or, alternatively and at the discretion of Riedel, by the competent court for the district of the Licensee's registered seat, establishment or assets.
